1. WARRANTY

• Ecus guarantees this product according to Royal Legislative Decree 1/2007, of November 16, 2007, and Royal Decree Law 7/2021, of April 27, 2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (“LGDCU”), as well as any other regulation that complements or develops it.

2. IMPORTANT NOTES

• This legal guarantee applies to Ecus products from the range of rest products, which includes, among others, wooden storage beds, upholstered storage beds and upholstered matresses bases.
• Before using the product, carefully read the contents of this warranty card and the accompanying instructions and care guide.
• The Ecus warranty offers free repair or replacement of the product in accordance with the terms and conditions set forth below.
• The Ecus warranty does not affect the rights that, by law, correspond to the purchaser in accordance with the legal regulations in force.

3. TERMS AND CONDITIONS OF THE LEGAL WARRANTY

Ecus’ legal warranty starts to run from the date of delivery of the product, with delivery being understood to have been made on the day that appears on the invoice or receipt of purchase or on the corresponding delivery note if this is later.

• The Ecus legal warranty only applies upon presentation of the original purchase invoice.
• The corrective measures to bring the good into conformity will be free of charge for the consumer, in accordance with the terms established in the GLDCU.
• Ecus is not responsible for any loss and/or damage to the product caused by external factors or during the assembly of the product by a third party external to Ecus.
• In order to be able to exercise the rights granted under this legal warranty, the products must be installed in accessible locations that make repair possible. In any case, it will be the responsibility of the installer to choose while the assembly and installation is being executed and of the final owner to facilitate access to said product, the manufacturer of the product being exempt from any expense.

4. STATUTORY WARRANTY PERIOD

The legal warranty of this product shall be that which is legally applicable in accordance with the regulations in force at the time of purchase of the product and shall begin to run from the date of delivery of the product, with delivery being understood to have been made on the day that appears on the invoice or receipt of purchase or on the corresponding delivery note if this is later.

5. EXCLUSIONS FROM THE LEGAL WARRANTY

Ecus’ legal warranty covers defects in materials and workmanship and functionality of the products as stated in the contract. The following cases are excluded from this legal guarantee:

• Failure to comply with any of the requirements mentioned in this legal guarantee card.
• Any component or accessory inside or outside the product, which is not specified or included in this warranty card or is not part of the original product, as well as the failures produced by them.
• Any defects and damages, caused by improper use, incorrect adjustment, improper calibrations and installations or by negligence or non-compliance with the user’s manual or care guide, as well as normal wear and tear and external factors, including those of transport and unpacking, to be claimed in the presence of the transport company’s personnel.
• Damage to third party items resulting from improper use, including but not limited to (i) use of the product for purposes other than those for which it is intended by its nature; (ii) use of the product in a manner that does not comply with the applicable technical or safety standards as set forth in this warranty card; (iii) non-compliance with the use and maintenance guide; or (iv) non-compliance with the use and maintenance guide. (iv) non-compliance with the instructions in the Technical Manual or Installation Guide.
• Logical consequences of the use and enjoyment of the product, such as wear and tear of the fabrics.
• Breakdowns caused by abusive/incorrect use of the product for purposes other than those for which it was manufactured.
• Breakdowns caused by fire, flood, meteorological agents, impact or crushing.
• Malfunctions caused by the use of the product in insalubrious places or not complying with the instructions and care guide.
• Damage to fabrics caused by chemical agents (detergents, bleaches, etc.) resulting from misuse of cleaning instructions.
• If the product is repaired or tampered with by personnel not authorized by ECUSSLEEP, modification or removal of the serial number, remanufacturing or use of non-original spare parts.
• Products that do not have the factory serial number identified or when the serial number has been altered or erased.
• Small noises produced by the movements of the mattress and its supports, especially mechanical. The rest assembly (mattress plus support) is a flexible element and can generate slight sounds when movements are applied.
• Those products marketed by Senttix that have a variation in their measurements lower than the difference allowed by the European regulation on tolerances in measurements of rest products, UNE-EN 1334:1996.
• Stains produced by a lack of ventilation and air circulation in the room. As well as the odors of the first days of the mattress. They are not harmful and disappear within a few days.
• Damages that have occurred over time and have worsened or have occurred repeatedly due to the failure to exercise legal warranty rights earlier, thus causing further damage.

6. COMMERCIAL GUARANTEE

In addition to the legal warranty, the following commercial warranties may be applicable in the Spanish national territory and under the terms and conditions indicated below. This commercial warranty is granted on certain components of the Ecus range of sleep products free of charge, in case of non-conformity of the goods. The specific components on which this commercial warranty is exclusively granted are the following:

• Pocket spring cores: will have a commercial guarantee of 15 years.
• The rest of the components of the product: will have a commercial warranty of 3 years.

Excluded from the commercial warranty are parts subject to wear and tear, including but not limited to: batteries, motor, piston, hinge, electrical components, etc.
